Section 1
1. Citation. This Law may be cited as the Widows’ and Orphans’ Pensions Law.
Section 2
2. Obligation on European officers transferred or appointed to Delta State to be contributors under Laws of the Federation and Lagos 1958. Subject to the exceptions contained in sections 4 and 5 of the Widows’ and Orphans’ Pensions Act hereinafter referred to as “the Act”)- [No. 3 of 1964.] (a) every European officer transferred to the public service of the Delta State of Nigeria under the provisions of paragraph 7 of the Second Schedule to the Constitution of Mid-Western Nigeria Act, 1964, who was immediately before the date of his transfer a contributor under the Act shall continue to be a contributor under and subject to the provisions of the Act; (b) every European officer appointed permanently or temporarily to a post in the public service of Mid-Western Nigeria or of the Delta State of Nigeria on or after the 7th February, 1964, shall become or continue to be a contributor under and subject to the provisions of the Act from the date on which he commences to draw any of the salary of such post.
Section 3
3. Application of F. & L. 1958. Provisions similar to those contained in the Act shall apply in relation to every officer to whom section 2 of this Law refers and to his dependants.
Section 4
4. Information to be supplied to Federal Government and Crown Agents. The Government of the Delta State shall from time to time as information and when required supply to the Government of the Federation and to the Crown Agents for Overseas Governments and Administrations (hereinafter referred to as “the Crown Agents”) in relation to every officer to whom section 2 of this Law applies such information and assistance as may be necessary for the administration of the Law.
Section 5
5. Contributions to be deducted by appropriate authority. When the salary or pension of a contributor to whom section 2 applies is not wholly paid through the Crown Agents his contributions shall be deducted from his salary or pension as the case may be by the appropriate authority in Nigeria.
Section 6
6. Adoption and adaptation of F. & L. 1958. The Delta State shall be deemed to be a State which has adopted the Act within the meaning of the Adaptation of Pensions Law Order, 1955, and the Act shall apply to the State as adapted by that Order. [LN 91 of 1955.]
Section 7
7. Application of Federal legislation by order. In event of the Act or the rules and regulations thereunder being amended by the National Assembly, the Executive Council may by order provide that such legislation shall be operative in the Delta State and any such legislation shall thereupon be as valid as if enacted by the State legislature.
