THE LEGAL OFFICERS (HARMONISATION OF SALARIES WITH MAGISTRATES) LAW

1. Citation. This Law may be cited as the Legal Officers (Harmonisation of Salaries with Magistrates) Law.

2. Interpretation. In this Law - "judicial officer" means a magistrate in any of the grade or Categories listed in the Schedule to this Law and shall include a Chief Registrar of the High Court and the Chief Registrar of the Customary Court of Appeal and Revenue Court Judges; [Schedule.] "legal officer" means Legal Officers in the State House of Assembly, Legal Officers in the employment of the Local Government Service Commission, Legal Officers other than Judicial Officers in the State Judicial Service Commission and other Legal Officers performing legal duties in theCivil and Public Services of Delta State; "State" means the Delta State of Nigeria.

3. Salaries. The salary structure of judicial officers set out in the Schedule to this Law and as may from time to time be applicable to judicial officers shall apply to all legal officers of the State Ministry of Justice, the State House of Assembly, the Local Government Service Commission, legal officers other than judicial officers of the Judicial Service Commission and other legal officers performing legal duties in the Civil and Public Services of Delta State and accordingly, as from the commencement of this Law, salaries to be paid to such legal officers shall be determined by reference to such salary structures. 4. Allowances and benefits applicable to legal officers. Such allowances and benefits including retiring benefits, as may from time to time be applicable to judicial officers, shall apply to all legal officers of the State Ministry of Justice, legal officers of the State House of Assembly, the Local Government Service Commission, legal officers other than judicial officers of the Judicial Service Commission and other legal officers performing legal duties in the Civil and Pubic Services of Delta State.

5. Other benefits or legal instruments. Nothing in this Law shall prevent the implementation of any other law or instrument enforceable in the State which shall provide for other employment benefits to legal officers.

6. Status. (1) The status and remuneration of the Chief Registrar of the High Court and Customary Court of Appeal of the State as well as that of the Revenue Court Judges shall be as that of a Permanent Secretary in the State. (2) As from the commencement of this Law, such allowances and benefits including retiring benefits, as may from time to time be applicable to Permanent Secretaries in the State Civil Service shall apply to the Chief Registrar of the High Court and the Chief Registrar of the Customary Court of Appeal as well as the Revenue Court Judges.
