Prohibition and Proscription of Youths Associations and Organisations Law

PROHIBITION AND PROSCRIPTION OF YOUTHS ASSOCIATIONS AND ORGANISATIONS LAW

1. Citation. This Law may be cited as. the Prohibition and Proscription of Youths Associations and Organisations Law.

2. Interpretation. In this Law- "activity" includes any act that is unlawful, criminal, or otherwise inimical to peace, public safety, public morality, public health, public order and good government, development and progress of the State or any part thereof or that in any way, howsoever unlawfully, puts the life, property, trade, business or interest in any lawful thing of any person or Government in danger or ruins or deprives or denies any person or Government of the lawful use or possession of any thing or place for any period of time; "association" means a group of two or more persons with a common objective to pursue an activity as defined in this Law; "Government" means Federal, State or Local Government or any of its agencies or departments; "Governor" means the Governor of Delta State; "place" includes any building, permanent or temporary structure, private or public installations or building site or land; "State" means Delta State of Nigeria; "thing" includes any property.

3. Prohibition and proscription of youths associations and activities. Save those associations or organisations listed in the Schedule to this Law, every association, organisation or group whether community or ethnic based, registered or unregistered, by whatever name called or known, operating in the State or any part of the State engaged in pursuing activities which are- (a) not in the interest of public safety, public order, public morality or public health; (b) illegal, inimical to peace, order, security, development and progress of the State or any part of the State; (c) anti-social and put the life of any person, property, trade, stock-in-trade, profession, services, business or interest in any lawful thing in danger or ruins; (d) aimed at terrorising in any form any person or community; (e) aimed at extorting money or money's worth from any person or community; or (f) otherwise unlawful or destructive, are hereby prohibited and proscribed throughout the State or any part thereof.

4. Exemption order. The Attorney-General may from time to time, with the approval of the Governor, make an order exempting any association, organisation or group whose activities, in the opinion of the Governor, are for the advancement of public safety, public order, public morality, religion, social, political ideals, education, economy or the public good of the State: Provided that the Governor reserves the right to revoke an exemption order whenever such organisation, association or group engages in an activity defined in section 2 of this Law.

5. Offences. It shall constitute an offence punishable under this Law for- (1) any person to belong to or purport to be an official or a member of a prohibited or proscribed association, organisation or group in pursuance of section 3 of this Law; (2) any person to engage himself or organise other persons to participate in the activities of any association, organisation or group prohibited or proscribed in pursuance of section 3 of this Law; (3) any person who aids, abets or participates in the violation of or non-compliance with any of the provisions of this Law.

6. Penalty. (1) Any person who commits an offence under this Law shall be tried summarily by any Magistrate’s Court in the State. (2) Any person who is found guilty of an offence under this Law shall be liable upon conviction to a term of seven years imprisonment with hard labour.

7. Repeal. The Proscription of Youth Association Law No. 6 of 1996 is hereby repealed. PROHIBITION AND PROSCRIPTION OF YOUTHS ASSOCIATIONS AND ORGANISATIONS LAW (i) Boys Scouts of Nigeria. (viii) Sheriff Guards of Nigeria. (ix) Nigerian Girl Guides Association. (x) Royal Ambassador. (xi) Catholic Youth Organisation. (xii) Anglican Youth Fellowship. (xiii) God's Grace Youth Movement. (xiv) Church of God Mission Youth Fellowship. (xv) St. Saviour's Youth Fellowship. (xvi) Young Women Christian Association (Y/teen). (xvii) Voluntary Work Camp. (xviii) Award Theatre. (xix) First Aid Group of Young Muslim Congress. (xx) Seventh Day Adventist Youth Organisation. (xxi) Baptist Youth Organisation. (xxii) Young Nigerian Citizen. (xxiii) Nigeria Youth Organisation.
