PENSION REFORM (AMENDMENT)
LAW, 2011
Section 1
1. Short Title and Commencement.
This Law may be cited as the Pension Reform (Amendment) Law, 2011 and shall come into
force on the 21st day of March, 2013.
Section 2
2. Interpretation.
In this Law,
"Principal Law" means, the Pension Reform Law, 2008.
Section 3
3. Amendment of Section 1 of the Principal Law.
Section 1 of the Principal Law is hereby amended by deleting the commencement date of
"16th day of April, 2008" and substituting a new commencement date of "1st day of
March, 2007".
Section 4
4. Amendment of Section 2 of the Principal Law.
Section 2 of the Principal Law is amended by inserting the words "as amended" after the
word "1999" in the interpretation of the words "Public service of the State".
Section 5
5. Amendment of Section 5 of the Principal Law.
Section 5 of the Principal Law is hereby amended;
(a) by deleting subsection (1) and
(b) by deleting subsection (2) and substituting the following subsection (2) Paragraphs (a)
and (b):
"(2) (a) the categories of persons mentioned in section 291 of the Constitution of the
Federal Republic of Nigeria 1999 as amended as well as those officers on consolidated
salary scale in the main civil service and the rank of professor in the State University, who
retire with their full salaries and benefits for life under the existing scheme, shall be
exempted from the scheme and allowed to retire on the old pension scheme;
(b) the total contribution to the new scheme by the categories of officers mentioned in
subsection 2(a) in the Main Civil Service, the state university or persons mentioned in
section 291 of the Constitution of the Federal Republic of Nigeria, 1999 as amended before
their appointment to the bench, shall be paid into the state consolidated Revenue Fund
and paid to them immediately after retirement"; and
(c) by deleting the words "(1) and" in subsections (3) and (4).
Section 6
6. Amendment of Section 11 of the Principal Law.
Section 11 (1) (b) of the Principal Law is hereby amended by deleting the word "and "half"
before the word "percent" in line 1.
