DELTA STATE UNIVERSITY OF SCIENCE AND TECHNOLOGY, OZORO (ESTABLISHMENT) (AMENDMENT) LAW, 2024

1. Short Title and Commencement. This Law may be cited as the Delta State University of Science and Technology, Ozoro (Establishment) (Amendment) Law, 2024 and shall come into force when it receives the assent of the Governor.

2. Interpretation. "Principal Law" means the Delta State University of Science and Technology, Ozoro (Establishment) Law, 2021.

3. Amendment of Section 1 of the Principal Law. Section 1 of the Principal Law is amended by deleting the entire Section 1 and substituting a new Section 1 as follows: "This Law may be cited as the Southern Delta University, Ozoro (Establishment) Law, and shall come into force on the date it receives the assent of the Governor".

4. Amendment of Section 2 of the Principal Law. Section 2 of the Principal Law is amended by deleting the definition of "University" and substituting a new definition of University as follows: ""University" means the Southern Delta University, Ozoro as established in Section 3 of the Principal Law"

5. Amendment of Section 3 of the Principal Law. Section 3(1) of the Principal Law is amended by deleting the entire subsection (1) and substituting a new subsection (1) as follows: "(1) There is hereby established for the State a University to be known as "Southern Delta University, Ozoro".

6. Saving/Transitional Provisions of the Principal Law. Anything done or purported to have been done under the Principal Law remains valid unless and until the contrary is proven, be presumed to be so effective. 1. The members of the University shall be: (a) the Visitor; (b) principal officers of the University; (c) members of the Council; (d) members of the Senate; (e) members of the academic staff; (f) members of the non-academic staff; (g) members of Convocation; (h) students; and (i) such other persons as may by Statute be granted the status of members.

2. A person shall remain a member of the University so long as he or she is qualified for such membership under any of the sub-paragraph 1 of the Statute. Statute 2

1. Honourary Degree. The University may, without examination, confer an Honourary Doctorate Degree of any Faculty on any person whom it may deem worthy of such a distinction: Provided that the holder of such Degree shall not be entitled to practice any profession or hld himself out as possessing any skill in any particular branch of learning merely by virtue of the award to him of such Honourary Degree.

2. No person shall be admitted by the University to an Honourary Doctorate Degree unless his name has been recommended for the award of an Honourary Doctorate Degree by a Joint Committee of Council and Senate and the recommendation is approved by the Senate and Council.

3. (1) The Joint Committee of the Council and the Senate referred to in paragraph 2 of this Statute, which shall be known as Honourary Degree Committee, shall consist of: (a) the Vice-Chancellor, who shall be the Chairman; (b) three members of the Council (not being also members of the Senate) nominated by the Council; and (c) six members of the Senate nominated by the Senate. (2) The members appointed by the Council or the Senate shall hold office for two years at a time and shall be eligible for re-appointment. (3) The Council after consultation with the Senate may make Regulations governing the procedure to be followed in dealing with proposal for the conferment of Honourary Degrees. Statute 3

1. The common seal of the University shall be in the custody of the Registrar and shall be used only as approved.

2. The Registrar is authorized to affix common seal: (a) to the certificate or other like instrument issued to a person as evidence that a degree, diploma or honour has been conferred upon or awarded to him bythe University. (b) to all copies of any Statute or Regulations made under the provisions of this Law required for production in any court or before any person acing judicially.

3. Any other instrument or document required by law to be under the common seal shall have the seal affixed to it only by regulation of the Council; provided that in respect of any document which in the opinion of the Pro-Chancellor or Vice-Chancellor is formal or of extreme urgency, the seal may be affixed by the direction of the Pro-Chancellor or the Vice-Chancellor and the action thus taken shall be reported to the Council at the earliest opportunity.

4. (1) Where it is provided that the seal shall be affixed only by resolution of Council, or may be affixed on the direction of the Pro-Chancellor or the Vice-Chancellor, the document to which he seal is affixed shall be attested by the signature of the Registrar and the Pro- Chancellor or, in his absence, the Vice-Chancellor. (2) Where the seal is affixed to a document required for production in any court or before any person acting judicially, the document shall be attested by the signature of the Registrar. (3) Where the seal is affixed to any certificate or other like instrument issued to a person as evidence that a degree, diploma or honour has been conferred upon or awarded to him by the University, the certificate or instrument shall be attested by the signature of the Vice-Chancellor and the Registrar.
