DELTA STATE STRUCTURES FOR SIGNAGE AND ADVERTISEMENT AGENCY (AMENDMENT) LAW, 2024
Section 1
1. Short Title and Commencement. This Law may be cited as the Delta State Structures for Signage and Advertisement Agency (Amendment) Law, 2024 and shall come into force on the date it receives the assent of the Governor.
Section 2
2. Interpretation. In this Law, unless the context otherwise requires: "Principal Law" means the Delta State Structures for Signage and Advertisement Agency Law, 2016.
Section 3
3. Amendment of Section 2 of the Principal Law. Section 2 of the Principal Law is amended by inserting the definition of "Governing Board" means the Board of the Agency established in Section 5 of this Law.
Section 4
4. Amendment of Section 3 of the Principal Law. Section 3 of the Principal Law is amended by inserting new subsections (3) and (4) as follows: "(3) For the purpose of this Law, the power of each Local Government shall include regulation, assessment, levy and collection of charges and fines on structures for signage and advertisement(s) within its jurisdiction. (4) Notwithstanding the provisions of subsection (3) of this Section and for the purpose of collaboration between the State and the Local Governments for the effective management and uniform control of structures for signage and advertisement within the State, the Local Governments may enter into contract with the Agency to regulate, levy, assess and collect the fees and fines payable; under this Law."
Section 5
5. Amendment of Section 5(1) of the Principal Law. Section 5 (1) of the Principal Law is amended by deleting the entire subsection and substituting a new subsection (1) as follows: "5(1) There is hereby established for the Agency a Governing Board, which shall be responsible for running the affairs of the Agency. The Board shall consist of: (a) a Chairman, who shall be appointed by the Governor from among the Chairmen of Local Government Council Areas in the State; (b) the Chairmen of each of the Local Government Council Areas or their representative(s); (c) the Managing Director of the Agency; (d) the Secretary to the Agency who shall be the Secretary of the Board; (e) one representative each of the following Directorate and Ministries: (i) Directorate of Local Government Affairs, (ii) Ministry of Environment, (iii) Ministry of Justice, (iv) Ministry of Transport, (v) Ministry of Works, (vi) Ministry of Information, (vii) Ministry of Lands and Survey, (viii) Ministry of Urban Renewal; (f) economic Adviser to the Governor; (g) two (2) representatives of the Delta State Chapter of the Outdoor Advertising Association of Nigeria (O.A.A.N); and (h) a representative of the Department of Environment in the Local Government Councils.
Section 6
6. Amendment of Section 17 of the Principal Law. Section 17 of the Principal Law is amended by inserting new paragraph (ca) as follows: "(ca) subject to the approval of the Governor, have the power to review the rates of fees/charges relating to mounting/erection of outdoor structures for signage and advertisement(s) from time to time."
Section 7
7. Amendment of Section 23 (2) of the Principal Law. Section 23 (2) of the Principal Law is amended by deleting the word "serves" after the word "satisfactorily" and insert the word "served"
Section 8
8. Amendment of Schedule 3, paragraph (3) of the Principal Law. Schedule 3, paragraph (3) of the Principal Law is amended by deleting the word "dale" and insert the word "sale".
Section 9
9. Amendment of Schedule 4, Paragraph (1) (a) of the Principal Law. Schedule 4, Paragraph (1) (a) of the Principal Law is amended by deleting the phrase "non- or-off-premise" and substituting the phrase on premise(s) or off-premise(s).
