DELTA STATE SECURITY LIGHTS IN PREMISES (INSTALLATION) LAW

1. Citation. This Law may be cited as the Delta State Security Lights in Premises (Installation) Law.

2. Interpretation. In this Law unless the context otherwise requires- "bulb" means an electric lamp with incandescent filament and includes a fluorescent lamp; "security light" means an electric light installed outside any building but within the premises.

3. All premises to have security lights. (1) Every owner or occupier of any premises shall install security lights in his premises. (2) The security lights shall be of such brightness as will illuminate the whole premises and its precincts. (3) The security lights, shall not be less than four in number, in which case one shall be installed at each side of the house or premises.

4. Time to switch on. Every owner or occupier of premises shall switch on the security lights of his premises at half past six o'clock in the evening and keep them on until six o'clock in the morning.

5. Offences and penalties. (1) Any owner or occupier of premises who knowingly fails to install security lights in his premises as provided in this Law, shall be guilty of an offence and liable on summary conviction to a fine of one thousand naira for the first offence, and for a subsequent offence, five thousand naira or two months' imprisonment. (2) Any owner or occupier of premises who- (a) without reasonable cause prevents or in any way obstructs any designated officer of the Local Government from entering his premises to inspect the security lights therein; (b) fails to replace any burnt or dead security light bulb, or fails to maintain the security lights; (c) fixes a security light bulb of low or poor wattage; (d) fails or refuses to switch on his security light at the stated time; (e) having switched on the security light at the stated time does not keep them on until six o'clock in the morning, shall be guilty of an offence and liable on summary conviction to a fine of two thousand naira for the first offence, and for a subsequent offence, a fine of five thousand naira or a term of imprisonment not exceeding two months, or both.

6. Application. This Law shall apply to the State capital, Asaba and shall by order by the State Commissioner for Works be made applicable to other towns in the State where there is electricity supply by the Federal, State or Local Government agencies.

7. Designated officers to inspect premises. Designated officers of the local government may enter any premises and inspect security lights and they shall also have power to prosecute offenders under this Law.
