Delta State Model Primary Schools Law, 2014

DELTA STATE MODEL PRIMARY SCHOOLS LAW, 2014

1. Short title and commencement. This Law may be cited as the Delta State Model Primary Schools Law, 2014 and shall come into force on the 28th day of May, 2014.

2. Interpretation. In this Law: "Commissioner" means Commissioner in charge of Basic and Secondary Education; "Department" means the Education Services Department established under section 4 of this Law; "Executive Secretary" means the person appointed under Section 4 of this Law; "Governor" means the Governor of Delta State of Nigeria; "Model School" means Model Primary School established under this Law; "Model Primary School" means Model Primary School established under this Law; "Reception Class" means Kindergarten arm of the Model Primary School; "State" means Delta State of Nigeria.

3. Establishments/Objectives. (1) There is hereby established Model Primary Schools for the State. (2) The Objectives of the Model Primary Schools include to: (a) provide quality education for its pupils; (b) encourage and promote establishment of standard in schools; (c) provide course of instruction with the use of Montessori method of teaching for the Reception class; (d) promote the culture of discipline, hard work and scholarship;

4. Supervision of Model Schools. (1) There shall be established in the Governor's office, an Education Services Department which shall have administrative, supervisory and monitoring functions over the Model Schools in the State. (2) The Education Services Department shall be headed by an Executive Secretary with at least a first Degree in Education and not less than fifteen years practical teaching experience; and is registered with Teachers Registration Council of Nigeria. [Appointment of Executive Secretary] (3) The Executive Secretary shall be in charge of the day to day administration of the Education Services Department in the Governor's Office. [Functions of Executive Secretary] (4) The Executive Secretary shall report on the Model Schools to the Governor.

5. Composition of Education Services Department. The Education Services Department shall consist of the following Units: (a) Curriculum Development unit; (b) Examination and Standards unit; (c) Inspectorate unit; (d) Human Resources unit; (e) Finance & Accounts; and (f) Works unit;

6. Teaching Staff. (1) Each Model Primary School shall be headed by a head teacher who shall be an educationist with at least Bachelor of Education degree in Nursery and Primary education and not less than Ten years teaching experience. (2) The teaching staff shall be persons with at least National Certificate of Education in Nursery and Primary education and not less than five years teaching experience. (3) In addition to the qualifications contained in subsections (1) and (2) of this section, no head teacher or teacher shall be qualified for employment unless he is registered with Teachers Registration Council of Nigeria. (4) Subject to the qualification in subsection (2) of this section a teaching staff may be: (a) employed from the general public or labour market, or (b) a retired teacher who has distinguished himself while in the service. (5) Each teaching staff shall be designated as Education Officer and his employment shall be regulated by terms and conditions stated in his letter of employment. (6) The head teacher, teaching and non-teaching staff employed for the model schools shall be paid such remuneration and allowances as the Governor may approve from time to time.

7. Employment/Selection of teaching staff. The selection process for teaching staff shall be on merit and shall be conducted through competitive interview by a Committee which shall consist of: (a) the Executive Secretary of the Education Services Department as Chairman; (b) a nominee of the Governor; (c) a representative of the Head of Service; (d) a representative of Ministry of Basic and Secondary; and (e) the head of Human Resources unit who shall be the Secretary.

8. Management. The Head Teacher shall be in charge of the day to day management of the school and all matters of discipline shall be handled in Consultation with the Executive Secretary.

9. Admission. Admission of pupil into the Reception Class shall be by: (a) purchase and completion admission forms; and (b) oral interview for the pupil.

10. - (1) Admission into Primary One of the Model School shall be on the basis of: (a) Completion of admission forms; and (b) Competitive examination. (2) Mid-stream admission into primary classes is prohibited.

11. Fees. (1) The fees and other levies to be imposed on pupils of the reception class section shall be as approved by the Governor. (2) No fees or levies shall be imposed, charged on or collected from pupils of the primary school section.

12. Penalty. Anybody who facilitates the admission or admits any pupil into the Model Schools contrary to sections 9 and 10 shall be guilty of an offence and liable on conviction to three months imprisonment or a fine of fifty thousand naira or both.

13. Directives. The Governor may give to the Education Services Department directives of general character or relating generally to particular matters with regard to the exercise by the Department of its functions.

14. 0 The Executive Council may by Order published in the State Gazette add or remove a school from the list of Model Schools in the Schedule.
