Delta State Governor and Deputy Governor Pension Rights and Other Benefits (amendment) Law, 2019

DELTA STATE GOVERNOR AND DEPUTY GOVERNOR PENSION RIGHTS AND OTHER BENEFITS (AMENDMENT) LAW, 2019

1. Short title and Commencement. This Law may be cited as the Delta State Governor and Deputy Governor Pension Rights and Other Benefits (Amendment) Law, 2019 and shall come into force on the 11th day of December, 2019.

2. Interpretation. (1) In this Law: "Principal Law" means the Delta State Governor and Deputy Governor Pension Rights and Other Benefits Law, 2005. (2) Section 2 of the Principal Law is amended by inserting before the definition of "Accountant-General" the following definition: "Acting Governor" means a person who discharges the functions of Governor pursuant to Section 191(2) of the Constitution of the Federal Republic of Nigeria 1999, as amended.

3. Establishment of Pension and Other Rights of Governor, Deputy Governor and Acting Governor. Section 3 of the Principal Law is deleted and the following Section is substituted: "3(1) A person having held the Office of Governor or Deputy Governor and having not been impeached from the Office, shall on leaving Office be entitled to pension for life in addition to other benefits as stipulated in the 1st and 2nd Schedules to this Law. (2) A person who discharged the functions of Governor as Acting Governor and having not been impeached from Office, shall on leaving Office be entitled to pension for life in addition to other benefits as stipulated in Schedule 1 "Table C" and Schedule 2 "Part 3" to this Law".

4. Amendment of Section 6 of the Principal Law. Section 6 of the Principal Law is amended by inserting after subsection (1) the following subsection: "(1a) The pension payable to a person who has held Office as Acting Governor shall be 70% of the annual salary of the incumbent Deputy Governor."

5. Amendment of Schedule 1 of the Principal Law. Schedule 1 of the Principal Law is amended by inserting after TABLE B the following TABLE: "TABLE C" SECTION 3 Formula for Calculation of Pension in Respect of Former Acting Governor TENURE - PENSION AS PERCENTAGE OF MONTHLY SALARY OF INCUMBENT DEPUTY GOVERNOR ACTING - 70%

6. Amendment of Schedule 2 of the Principal Law. Schedule 2 of the Principal Law is amended by inserting after PART 2 the following PART: "PART 3" TENURE COMPLETION BENEFITS FOR FORMER ACTING GOVERNOR OF THE STATE Personal Staff:

1. (1) An officer not below Grade Level 12 shall be the Administrative officer. (2) A personal Secretary not below Grade Level 09 who shall be selected by the former Acting Governor and paid by the Stats Government.

2. Security: (1) Two (2) armed policemen. (2) One (1) Department of State Services Officer not below the rank of ASO, shall be the Chief Detail to be attached for life and paid by the Department of State Services, who shall be changed in every four years period.

3. Vehicle: (1) One vehicle to be bought by the State Government and liable to be replaced every four years. (2) The Driver shall be selected by the former Acting Governor, and paid by the State Government.

4. Medical Service and Vacation: (1) Free medical treatment for former Acting Governor and his immediate family within Nigeria. (2) Treatment abroad for former Acting Governor and his immediate family where necessary at the State Government expense. (3) 15 Days annual vacation within Nigeria at the State Government expense. Such expense shall be approved by the serving Governor of the State.

5. Provision of Office Accommodation: A well furnished and equipped office in any location in the State on the choice of the former Acting Governor.

6. Telephone: One direct telephone line provided at the expense of the State Government, except in a remote area where an alternative mobile unit will be procured and paid by the State.

7. National Flag: The National Flag shall be flown at half mast for a period of three days after the death of a former Acting Governor as a sign of State mourning at all public buildings in the State.
