Delta State Farm Settlement (miscellaneous Provisions) Law

DELTA STATE FARM SETTLEMENT (MISCELLANEOUS PROVISIONS) LAW

1. Citation This Law may be cited as the Delta State Farm Settlement (Miscellaneous Provisions) Law.

2. Interpretation In this Law "Appropriate authority" means the Commissioner in the State Government for the time being assigned responsibility for matters relating to agriculture and natural resources ; "Farm Settlers" means tenants of the State who have or would have holdings and homesteads in the farm settlements; "Governor" means the Governor of the State; "Ministry" means the Delta State Ministry of Agriculture and Natural Resources; "State" means the Delta State of Nigeria.

3. Powers of the appropriate authority Notwithstanding anything contained in any law to the contrary, the appropriate authority shall have power to establish and manage either by himself or through his agents, the Government farm settlements and enforce compliance with the provisions of this Law or by the use of task force setup for the purpose.

4. Regulations The appropriate authority may make regulations providing for all or any of the matters necessary to be provided for under this Law, and without prejudice to the generality, of the foregoing, may by such regulations - (a) provide land in designated areas in the state for farm settlements; (b) provide administrative/monitoring unit in each of the State farm settlements for effective management; (c) provide social amenities in the State farm settlements; (d) provide for charging rates and collection of revenue for the State from the farm settlers; and (e) provide for the review from time to time of the various rates if necessary by the appropriate authority

5. Obstructing performance of Official duty It shall be an offence punishable with a fine of N100,000 (One hundred thousand naira) or imprisonment for a term not exceeding one year or both for any person to willfully obstruct, arrest,resist or manhandle the appropriate authority or his agents in the course of the performance of their duties under this Law.
