Preliminary

DELTA STATE CUSTOMARY COURTS (AMENDMENT) LAW, 2019

Section 1

1. Short title and Commencement. This Law may be cited as the Delta State Customary Courts (Amendment) Law, 2019 and shall come into force on 30th day of January, 2020.

Section 2

2. Interpretation. In this Law: "Principal Law" means Delta State Customary Courts Law, 2019.

Section 3

3. Amendment of Section 3 of the Principal Law. Section 3 of the Principal Law is amended as follows: (a) by deleting in subsection (3) the words "shall upon the recommendation of the Commission" and substituting "may in consultation with the Commission". (b) by deleting in subsection (5) the word "revalidate" and substituting "vary"; and (c) by deleting in subsection (6)(b) the word "revalidation" and substituting "variation".

Section 4

4. Amendment of Section 5 of the Principal Law. Section 5 of the Principal law is amended by deleting subsection (3) and substituting the following subsection (3): "(3) Lay Members of Area and District Customary Courts shall hold office for a period of three years but shall be eligible for reappointment, subject to satisfactory annual evaluation report."
