COLLEGE OF EDUCATION, WARRI LAW

1. Citation. This Law may be cited as the College of Education, Warri Law.

2. Interpretation. In this Law unless the context otherwise requires- “academic staff’ means the teaching staff of the College; “appropriate authority” means any person for the time being charged with ultimate responsibility for the Ministry of Education; “Board” means the Academic Board established under section 38 of this Law; “Chairman” means the Chairman of the Council; “College” means the College of Education, established under section 3 of this Law; “Government” means the Government of Delta State of Nigeria; “Governor” means the Governor of Delta State of Nigeria; “graduate” means a person who has taken a university degree (other than an honorary degree) especially the first or Bachelors’ degree; “Provost” means the Provost of the College appointment under section 7 of this Law; “School” means a grouping of related academic departments administered under one headship; “State” means the Delta State of Nigeria; “student” means a person in statu pupillari at the College receiving regular or part-time courses of instruction for a set period and registered for this purpose in the College.

3. Establishment of College. (a) There is hereby established in the State an institution of higher learning which shall be called the College of Education, Warri. (b) The College shall be a body corporate having perpetual succession and a common seal and may sue and be sued in its corporate name.

4. Objects of College. The objects of the College are- (a) to provide courses of instruction and learning in the College for all persons of either sex without regard to race, ethnic group or creed for the purpose of producing well-qualified and Suitable non-graduate teachers; (b) to provide in-service training courses for all grades of graduate and non- graduate teachers with a view to raising the general standard of teaching; (c) to mould the attitude of young student teachers for the teaching profession; (d) to arrange for conferences, seminars, study groups and similar activities; (e) to identify itself with problems associated with learning and the teaching profession in the State and through research, offer ideas for the solutions of these problems by making their findings available to teachers in and outside the State through publications and other means; (f) to co-operate with the Ministry of Education- and other outside agencies invited by the former or by the College with the consent of the Ministry on matters associated with the execution of Government policies on teaching education; (g) to provide within the limits of its resources such facilities as are necessary for the achievement of the above objectives; and (h) to perform such other functions as in the opinion of the Council, may serve to promote the objectives of the College.

5. Constitution of College. The College shall consist of- (a) the Chairman and members of the Council; (b) the Provost of the College; (c) the Deputy Provost; (d) the Registrar; (e) the Bursar; (f) the Librarian; (g) all members of academic staff of the College; (h) all members of non-academic staff of the College; (i) all persons holding offices in the College; (j) all other employees of the College; and (k) all the students of the College.

6. Principal Officers of College. The Principal Officers of the College shall comprise- (a) the Provost; (b) the Deputy Provost; (c) the Registrar; (d) the Bursar; and (e) the college librarian.

7. Provost. (1) The Provost who shall be the chief academic officer and chief executive of the College shall be appointed for a term of four years by the Governor, from amongst three suitable persons of academic eminence recommended by the Council of the College through the appropriate authority. (2) The Provost may be reappointed for a second term of three years on the recommendation of the Council through the appropriate authority.

8. Functions of Provost. (1) The Provost as the head and chief executive of the College shall- (a) be responsible to Council for the day-to-day management of the College; (b) maintain discipline; (c) cater for the welfare and interest of the staff and students of the College; and (d) perform such other functions as may be conferred upon him by this Law or the Council. (2) The Provost shall execute the decisions of the Council.

9. Deputy Provost. (1) The Deputy Provost shall be appointment by the Council, on the recommendation of the Provost, from three persons nominated by the Academic Board. (2) The Deputy Provost shall be appointed from amongst the senior members of the academic staff holding the highest academic rank.

10. Functions of Deputy Provost. (1) The Deputy Provost shall assist the Provost and shall act in the place of the Provost when the office is vacant or when the Provost is absent or otherwise unable to perform his duties. (2) The Deputy Provost shall be responsible to the Provost for the day-to-day management of the academic schools and departments of the College and shall perform such other functions as may be assigned to him by the Provost.

11. Registrar. (1) The Council shall' appoint a Registrar for the College who shall be Responsible for the general administration of the College. (2) The Registrar shall be the secretary to the Council. (3) The Registrar shall be responsible to the Provost and perform such other functions as may be assigned to him by the Provost.

12. Bursar. The Council shall appoint a Bursar for the College who shall be the financial officer of the College and responsible for the planning, control and administration of the financial affairs of the College.

13. Librarian. The Council shall appoint a Librarian for the College who shall be responsible to the Provost for the planning, development and administration of the library.

14. Appointment of other staff. The Council Shall employ for the College such academic and non-academic staff as shall appear to it necessary.

15. Conditions of service of staff. The terms and conditions of service (including terms and conditions as to salaries, other remunerations and allowances and disciplinary control) of the Deputy Provost, Registrar, the Bursar, the College Librarian, the other academic staff and the non-academic staff of the College employed by the Council shall be prescribed by the Council.

16. Removal of principal and senior staff of College. (1) If it appears to the Council that there are reasons for believing that any of the principal officers or any member of the academic staff or any senior member of the administrative staff of the College should be removed from office on ground of misconduct or inability to perform the functions of the office, the Council shall- (a) give a notice in writing to the officer concerned, drawing his attention to the alleged misconduct or other default; (b) appoint an investigating committee to investigate and report to it (the Council) on the conduct of the officer concerned provided that if the officer is a principal officer of the College within the context of section 6 of this Law, members of the investigating committee shall be selected from amongst of the members of the Council and of the Academic Board, provided the nominee of the Academic Board shall not be lower in rank than the staff concerned; and (c) in respect of the Provost and other principal officers, the Council shall request the appropriate authority to nominate three persons of impeccable character outside the College for appointment by Council as additional members of the investigating committee. (2) The Council shall give the officer whose conduct is being investigated a reasonable opportunity to appear before and be heard by the investigating committee on the allegations made against the officer. (3) If after considering the report of the investigating Committee, the Council is satisfied that the officer whose conduct is the subject-matter of the investigation ought to be removed from office, the Council may by instrument in writing, signed by the Chairman remove the officer. In the case of the Provost, the Council may make recommendation to the Governor through the appropriate authority that the Provost be suspended or removed from office as the Council may decide. (4) The foregoing provisions of this section are without prejudice to the general power of the Council to exercise disciplinary control over members of staff of the College.

17. Provost may suspend staff. (1) The Provost may suspend a member of senior staff if, in the opinion of the Provost, the conduct of the staff is prejudicial to the interests, peace, law and order of the College. The Provost shall forthwith make a formal report of the suspension to the Council. (2) (a) Any person suspended pursuant to subsection (1) of this section shall be on such pay as shall be determined by the Council. The Council shall before the expiration of a period of three months after the date of such suspension, consider the case against that person and come to a decision as to- (i) whether to continue the person’s suspension and if so on what terms; (ii) whether to reinstate the person; (iii) whether to terminate the appointment of the person; or (iv) whether to take lesser disciplinary action against the person. (b) Where the Council, pursuant to this subsection, decides to continue a person’s suspension or decides to take further disciplinary action against a person, the Council shall before the expiration of a period of three months from such decision come to a final determination in respect of the case concerning any such person.

18. Termination. (1) For good cause, any member of staff may be dismissed or his appointment terminated by the Council, and for the purpose of this section “good cause” means- (a) a conviction for any offence which the Council considers to be such as to render the person concerned unfit for the discharge of the functions of his office; or (b) any physical or mental incapacity which the Council, after obtaining medical advice, considers to be such as to render the person concerned unfit to continue to hold his office; or (c) a conduct of scandalous or other disgraceful nature which the Council considers to be such as to render the person concerned unfit to continue to hold his office; or (d) a conduct which the Council considers to be such as to constitute failure or inability of the person concerned to discharge the functions of his office or to comply with the terms and conditions of his service. (2) The Council may terminate the appointment of any member of staff if; in the opinion of the Council, his services are no longer required, provided that in the case of a principal or academic staff, he shall be given three months’ notice or salary in lieu of notice and for other staff one month’s notice or salary in lieu of notice.

19. Regulations. (1) Nothing in this Part of this Law shall prevent the Council from making regulations for the discipline of members of staff of the College.

20. Resignation. (1) A principal officer or a member of the academic staff may resign his appointment by giving the Council three months’ salary in lieu of notice. (2) Any other staff may resign his appointment by giving one month’s notice or one month’s salary in lieu of notice.

21. Establishment of Council. There shall be established for the College a body to be known as the Governing Council.

22. Function of Council. (1) Subject to the provisions of this Law the Council shall be responsible for the general and overall arrangement, superintendence and control of the, affairs, policy, property and funds the College. (2) The Council shall be answerable to the Governor through the appropriate authority. (3) The Council shall- (a) approve the academic requirements for the admission of students into the College; (b) approve the qualifications to be conferred at the end of the courses and the form of the certificate to be awarded; (c) seek at all times the welfare and interest of the students and the entire members of the staff; (d) advise the appropriate authority on measures likely to promote the interests of the College and on matters of academic interests; (e) appoint, advance, promote and discipline members of the academic and non- academic staff of the College; (f) approve proposals from the Academic Board to organise and control the different courses of instruction and teaching in the College; (g) approve proposals for the organisation and headship of schools, departments and other units of the College; and (h) approve the students selected by the Academic Board for admission to the College.

23. Powers of Council. For the purpose of carrying out those functions under this Law the Council may- (i) institute and award scholarships, exhibitions, bursaries, medals, prizes and other titles, distinctions and wards; (ii) provide courses and establish other departments and schools in the College as may be deemed necessary from time to time; (iii) acquire, hold, grant charge or otherwise deal with or dispose of movable and immovable property or any interest in any land wherever situated as it thinks expedient for the purpose of developing and maintaining the College and of accomplishing its objectives and discharging its obligations under the provisions of this Law, provided that the Council shall not dispose of or charge any land or immovable property or any interest in any land wherever situated except with the written consent, either general or special, of the appropriate authority; (iv) accept gifts, legacies, and donations, but without obligations; (v) subject to any limitations, or conditions imposed by any edict, invest any monies standing to the credit of the College by way of endowment, whether for general or special purposes, and such other- monies, as may not be immediately required for current expenditure, in any investments or securities or in the purchase or on the improvement of land with power from time to time to vary any such investments or sell the securities; power under this subsection shall only be exercised subject to the written approval of the government in respect of speculative ventures; (vi) use all gains, profits, dividends, and all accruals accruing to the College from such venture in the promotion of its educational activities; (vii) carry out any function authorised by this Law; and (viii) do anything which in its opinion will advance the objectives of the College.

24. Composition of Council. The Council shall consist of the following members- (a) a Chairman to be appointed by the Governor; (b) the Provost; (c) the Deputy Provost; (d) one representative of the State Chapter of the Nigerian Union of Teachers to be appointed by the appropriate authority; (e) one representative of the conference of Principals of Secondary Schools in the State to be appointed by the appropriate authority; (f) six special members to be appointed by the Governor; (g) the Permanent Secretary, State Ministry of Education as ex officio member; (h) one representative of the Conference of Principals of Teacher Training Colleges to be appointed by the appropriate authority; (i) one representative of the Academic Board of the College who shall be nominated by the members of the Academic Board of/the College and appointed by the appropriate authority; (j) one representative of the. university of affiliation who shall be appointed by the Senate of that university; (k) one representative of the Congregation.

25. Tenure of office of members Council. (1) The Chairman and members of the Council appointed under Section 24 (1), (a), (d), (e), (f), (h), (i), and (J) shall hold office for a period of three years and may be re-appointed for a second term only. (2) The terms and conditions gf service of the Chairman and special members of Council shall be such as may be prescribed by the appropriate authority.

26. Resignation. Any special member of the Council including the Chairman may resign his appointment by giving one month’s notice in writing to the Governor or to the appropriate authority as the case may be.

27. Vacancy in Council. A vacancy shall occur in the membership of the Council in any of the following events- (a) death of a member; (b) inability, resulting from any cause, to discharge the' functions of the office; (c) conviction for a criminal offence involving fraud, dishonesty or moral turpitude; (d) resignation; (e) removal for misbehaviour or any other cause by the appointing authority; or (f) the dissolution of the Council.

28. Meetings of Council. (1) The Council shall meet as and when necessary for the performance of its functions under this Law but in any case not less than three times a year. (2) When one-third of the members of the Council give notice in writing signed by them requesting the Chairman to convene an emergency meeting of the Council stating in the notice the topic(s) to be discussed, on receipt of such a notice, the Chairman shall summon a meeting.

29. Presiding at meetings. The Chairman shall preside at all meetings of the Council and in his absence, the members present shall elect one of them to act as chairman at that meeting.

30. Co-option of members. Where Council desires to obtain advice for a particular purpose, it may co-opt not more than two persons for the purpose, and the persons so co-opted may take part in the deliberations of the Council at any meeting for which he was co-opted but shall not be entitled to vote.

31. Council to determine all questions relating to scope of responsibilities of staff. Any question as to the scope of the responsibilities of the Chairman, the Provost, the Deputy Provost, the Registrar, the Bursar, and the Librarian of the College shall subject to the Provisions of this Law be determined by the Council.

32. Quorum. The quorum of the Council shall be a third of the members of the Council.

33. Standing Orders. The Council may make Standing Orders to regulate its own procedure and may function notwithstanding any vacancy in its membership.

34. Bank accounts. The Council shall ensure that all monies received by or on behalf of it are promptly lodged with an approved bank on deposit or current account.

35. Borrowing power. The Council, with the approval of the Governor through the appropriate authority shall have power to borrow money upon such terms and conditions as the Governor may approve to enable it discharge its functions and meet its obligations under this Law and for the purpose of developing and maintaining the College.

36. Committees of Council. (1) The Council shall have power to appoint committees among its members and to authorise such committees to exercise on its behalf such of its functions as the Council may determine without prejudice to the Council itself exercising these functions. (2) The Provost and/or the Deputy Provost shall be members of every standing committee appointed by Council.

37. Payment of allowances. There shall be paid to the members of the Council and of other committees, who are not staff pf the College, allowances for travelling and other reasonable expenses, at rates to be fixed by the appropriate authority.

38. Establishment of Board. There is hereby established for the College an Academic Board.

39. Functions of Board. The Board shall advise the Council on all matters of academic policy and make recommendations and specifically shall- (a) approve proposals for curriculum and course developments for the Nigerian Certificate in Education (NCE) and other programmes approved by the appropriate authority; (b) set up an examination system and approve the results of examinations conducted by the College; (c) approve the appointment of examiners to conduct the final examinations for the different courses of instructions, where necessary, for the conferment of the prescribed qualifications and the award of the certificates; (d) recommend to Council for approval, students qualified, for the award of certificates; (e) receive evaluation reports on courses and schemes of work and to consider their implications for the College; (f) review methods of teaching in the College; (g) consider arrangements for field studies, visits and attachments, study abroad and all other aspects of the curriculum involving absence from College during term time or approved College work during vacations; (h) make arrangements for the regular review of the academic progress of students; (i) consider the procedure for the admission of students to courses of study and the publicity of courses; (j) select the students for admission into the College in accordance with Council policy; (k) consider the draft estimates and other financial matters related to academic policy; (l) determine the academic standard required in the different courses of instruction, to ensure that high standards are maintained in the College; (m) make proposals to the Council for the promotion of research and development; (n) recommend to the Council the number and grades of teaching staff annually, prior to the submission of draft estimates to the appropriate authority by the Council; (o) recommend to the Council how the total number of teaching staff of different grades shall be apportioned; (p) determine the structure and contents of the different courses of study.

40. Composition of Board. The Board shall consist of- (a) the Provost who shall be the Chairman; (b) the Deputy Provost; (c) heads of schools; (d) heads of academic departments of the College; (e) a representative of the Ministry of Education; (f) the Librarian; (g) a representative of the Institute of Education of the university of affiliation who shall be nominated by the university; (h) one representative of the Conference of Principals of Secondary Schools in the State nominated by that body for appointment to the Board by the appropriate authority; (i) all chief lecturers; (j) two members from the Congregation nominated by that body for two years.

41. Quorum. The quorum of the Board shall be a third of the members.

42. Procedure at meetings. The Board may regulate its own procedure as it may deem fit and may function notwithstanding any vacancy in its membership.

43. Division of College into schools, etc. The College shall be organised into other academic divisions as the Council may approve.

44. School Board of Studies. (1) There shall be established in respect of each School a School Board of Studies, which, subject to the provision of this Law, and subject to the directions of the Academic Board shall- (a) regulate the teaching and study of the subject assigned to the School and the conduct of the examinations thereof; (b) deal with any other matter assigned to it by this Law or by the Board; and (c) advise the Provost or the Board on any matter referred to it by the Provost of the Board. (2) Every School Board of Studies shall consist of- (a) the Provost; (b) the Deputy Provost; (c) the Head of the School who shall be the Chairman; (d) all heads of academic departments of the School; (e) all the teachers assigned to the School. (3) The quorum bf the School Board of Studies shall be one-third of the members.

45. Head of School. (1) The Head of School shall be appointed by the Board from among two lecturers not below the rank of senior lecturers who were elected by the School. (2) The Head of School shall hold office for a term of two years, and shall be eligible for re-election after two years have elapsed. (3) Without prejudice to subsections (1) and (2) of this section the Provost may appoint an acting Head of School who shall hold office for a period not exceeding six months in the first instance which appointment *may be renewed for a period not more than another six months. (4) The Head of School shall be the chairman of the School Board of Studies. (5) The Head of School shall exercise general superintendence over the academic and administrative affairs of the School. He shall also present to Convocation persons who have qualified for the certificates of the College at examinations held in the departments for which responsibility is allocated to the School. (6) The Head of School may be removed from office for good cause or on a petition by two-thirds pf full membership of the School Board of Studies. And in the event of a vacancy occurring, following the removal of a Head of School an acting Head may be appointed by the Provost to serve for the remaining period of that year.

46. Establishment of Congregation. There is hereby established for the College a body to be called the Congregation.

47. Composition of Congregation. (1) The Congregation shall consist of- (a) the Provost who shall be the chairman; (b) Deputy Provost; (c) the full-time members of the academic staff; (d) the Registrar; (e) the Bursar; (f) the Librarian; (g) every member of the administrative staff, who holds a degree of a recognised university. (2) The quorum of the Congregation shall be a third of the members of the Congregation. (3) Subject to the provisions of this Law, the Congregation may regulate its own procedure. (4) The Congregation shall express by resolution its opinion on any matters whatsoever relating to the College, including any matter referred to it by the Council or Board.

48. Revenue of the College. The revenue of the College shall include- (a) such sums of money as may from time to time accrue to College by way of subvention, grants-in-aid, endowment or otherwise; (b) donations and legacies accruing to College from any sources for the general and special purposes of the Council; and (c) any other sums of money, charges and dues recoverable by the College.

49. Estimates. (1) The Council shall by a date to be specified by the appropriate authority, submit for the consideration of the appropriate authority, draft revenue estimates for the twelve months beginning on 1st January of the following year, in a form approved by the appropriate authority. (2) The Council shall, as required by the appropriate authority, submit for the consideration of the appropriate authority proposals for capital expenditure in a form approved by the appropriate authority. (3) The Council, when considering the draft revenue estimates and the programme of capital expenditure shall take into account any recommendations of the Academic Board. (4) The appropriate authority shall, as soon as possible, transmit to the Council each year, the approved, revenue estimates for the twelve months beginning on 1st January, and any programme of capital expenditure for subsequent years beginning on 1st January as the appropriate authority may determine.

50. Revision of estimates. The appropriate authority shall be entitled in any mid-year to effect a general review of its financial position arising from the need to reduce previous planned levels of expenditure including a review of approved, revenue estimates of the College,40 make changes in those estimated and to require the Council to comply with any generally applied interim financial directions to be operated whilst such a review is in progress. If the estimates are thus reviewed, the revised estimates shall become the “approved revenue estimated” for the-purposes of this Law.

51. Authority to incur expenditure. (1) The Council shall have power, subject to the provisions of this Law, to incur expenditure under each head of the revenue estimates without further reference to the appropriate authority, provided that the Council shall not, without the consent of the authority, undertake a commitment, part of which can be financed within the current year, but which »will involve the appropriate authority in expenditure after the end of the current year. (2) The headings of revenue estimates shall be grouped into six groups as set out in the Schedule* to this Law: The Council shall have power by resolution to transfer monies from one head of expenditure to another within the same group provided that the total amount of the estimates for each group is not exceeded. [*At the time of going to print the Schedule was not available.] (3) The Council shall have power to incur expenditure on capital account subject to conformity with regulations.

52. Auditing accounts of the College. The Council shall ensure that proper accounts of the College are kept and that the accounts of the College are audited annually by the State Director of Audit and that an annual report is prepared by the Council together with certified copies of the said accounts as audited in respect of the period of twelve months ending with the preceding thirty-first day of December.

53. Students. All students registered in the College shall form part of the College.

54. No discrimination. No person shall be required to satisfy requirements as to race (including ethnic grouping), sex, place of birth or of family origin or religious or political persuasion, as a condition of becoming or continuing to be a student at the College, or of becoming or continuing to be the holder of any certificate of the College or the holder of any appointment or employment at the College, or of becoming or continuing to be a member of any body established by virtue of this Law, and no person shall be subjected to any disadvantage or accorded any advantage, in relation to the College by reference to any of these matters.

55. Discipline of students. (1) Subject to the provisions of this section, where it appears to the Provost that any student of the College has been guilty of misconduct, the Provost may, without prejudice to any other disciplinary power conferred on him by law or other regulations, direct- (a) that the student shall not, during such period as may be specified in the direction, participate in such activities of the College, or make use of such facilities of the College, as may be so specified; or (b) that the student be rusticated for such period as may be specified in the direction; or (c) that the student be expelled from the College. (2) Where a direction is given under subsection (1) (6) or (c) bf this section in respect of any student, the student may, within a prescribed period and in a prescribed manner appeal against the direction to the Council and where such an appeal is brought the Council shall after causing such inquiry to be made into the matter as it considers just, either confirm or set aside the direction or modify it in such a manner as the Council thinks fit. (3) The fact that an appeal from a direction is brought in pursuance of the last preceding subsection shall not affect the operation of the direction while the appeal is pending. (4) The Provost may delegate his power under this section to a disciplinary board consisting of such members of the College as he may nominate. (5) The Provost may empower the warden of a hostel to exercise disciplinary control (excluding rustication or expulsion) for breach of the hostel rules.

56. Withdrawal of students on academic grounds. (1) The Board shall have the power to require a student to withdraw from the College on academic grounds, or in the case of a student teacher, on academic or professional grounds. This power may be delegated by the Board to a subcommittee of the Board Constituted in such manner as may be determined, provided that its membership shall include both representatives of the teaching staff and the students. (2) The Board shall as soon as practicable make rules and review such to be followed by itself of by its subcommittee, in reviewing the academic or professional progress of students and making decisions thereon, and those rules shall be approved by the Council. (3) A student shall be entitled to appeal to the Council against any decision of the Board (or any subcommittee thereof).

57. Students' Union. (1) The Council shall make arrangements for a separate body to be known as Students’ Union representing the students to be established. (2) The Students’ Union with the approval of the Council shall have its own constitution and conduct and manage its affairs and funds. (3) The Students’ Union shall, in additional to other functions and powers which the Council may impose on it, make representation on matters concerning students’ welfare to the Council or Board or Provost as the base may be.

58. Senior Staff Appointments and Promotions Committee. (1) There is hereby established for the College a committee to be known as the Senior Staff Appointments and Promoting Committee. (2) The Committee shall consist of- (a) a member of the Council as chairman; (b) three other members of Council nominated by the Council; (c) the Provost; (d) the Deputy Provost; (e) one member of the Board; (f) one member of the Congregation. (3) The Committee shall be responsible for making recommendations to the Council for appointments and promotions including academic, administrative and other professional staff of the College.

59. Junior Staff Appointments, Promotions add Disciplinary Committee. (1) There is hereby established for the College a Junior Staff Appointments, Promotions and Disciplinary Committee. (2) The Committee shall consist of- (a) the Registrar who shall be chairman; (b) the Bursar; (c) the Librarian; (d) the head of department whose staff is being considered; (e) the Head of Internal Audit Department; (f) the Head of Works and Maintenance Department; (g) an administrative officer to serve as secretary. (3) The Committee shall make recommendation to the Provost on the appointments/promotions and discipline (including dismissal) of junior staff, and thereafter inform Council of the decision taken.

60. Right of appeal. A member of the staff of the College who has been investigated and disciplined on the recommendations of the committee set up under the provisions of this Law has the right to appeal to the Council within a period to be prescribed by Council, provided always that such appeal is passed through the Provost.

61. Other committees and subcommittees. The Council and the Board shall establish such committees as they think fit (including where appropriate, committees with a membership which includes representatives of the student body) and shall determine their membership and functions.

62. Common seal. (1) The common seal of the College shall be in the form to be prescribed by the Council and any two of the following shall authenticate the affixing of the seal- (a) the Provost; (b) a member of the Council other than the Provost; (c) the Registrar; or (d) any other person authorised by the Council. (2) The seal shall be kept with the Registrar of the College. (3) Any document purporting to be a document executed under the common seal of the College authenticated as aforesaid shall be received in evidence and shall, unless the contrary is proved, be deemed to be duly executed. (4) Any contract or instrument, which, if made or executed by a person not being a body corporate, would not be required to be under seal, may be made or executed on behalf of the College by any person generally or specially authorised to do so by the Council. (5) The common seal of the Council shall not be used or affixed to any document except in pursuance of a resolution of the meeting of the Council and recorded in the minutes of such meetings.

63. Validity of proceedings of Council. The validity of any proceedings of the Council shall not be affected by any vacancy in the membership of the Council, or by reason that any person not entitled to do so took part in the proceedings.

64. Disclosure of interest. Any member of the Council who has a personal interest in any matter proposed to be considered by the Council shall forthwith disclose his interest to the Council.

65. Services of notices. Any notice or other instrument authorised or required to be served by virtue of the Law may without prejudice to any other mode of service be served by post.

66. Transfer of property rights and liabilities. (1) All real and personal property vested in the College under the provision of the College of Education, Warri Law (hereby repealed) shall be transferred to and shall without further assurance vest in the same interest in the College. (2) Subject to the provisions of the Law, all rights and liabilities which immediately before the coming into force of this Law were vested in or imposed on the old College shall be deemed to be rights and liabilities of the College. (3) All references to the old College in any law, regulation, order or, other enactment, enactment, or in any agreement, deed, instrument, application, notice or other document shall, unless the context otherwise requires be read as references to the College.
