CIVIL SERVICE COMMISSION LAW, 1980
Section 1
1. Citation. This Law may be cited as the Civil Service Commission Law, 1980.
Section 2
2. Interpretation. In this Law, unless the context otherwise requires- "Chairman" means the chairman of the Commission; "Civil Service of the State" has the meaning assigned to it under {he Constitution of the Federal Republic of Nigeria in force; "Commission" means the State Civil Service Commission established under section 3 of this Law; "Commissioner" means a member of the Commission other than the Chairman; "Constitution" means the Constitution of the Federal Republic of Nigeria in force; "function" includes powers and duties; "Governor" means the Governor of Delta State of Nigeria; "regulations" means any regulations made by the Commission in the exercise of powers conferred by the Constitution; "State" means Delta State of Nigeria.
Section 3
3. Establishment of the Commission. (1) There is hereby established for the State a commission to be known as the Delta State Civil Service Commission (hereinafter referred to as “the Commission”). (2) The composition and powers of the Commission shall be as set out in the Constitution of the Federal Republic of Nigeria in force.
Section 4
4. Application of the Constitution. The provisions of the Constitution, which respectively relate to the Commissioner with particular regard to- (a) appointment of Chairman and members; (b) tenure of office of members; (c) qualifications for membership; (d) removal of members; (e) independence of the Commission; (f) quorum and decisions; (g) powers and procedures, shall apply in relation to the Commission.
Section 5
5. Protection in proceedings. The Chairman and every Commissioner shall have the same protection and privilege in the case of any action, suit or proceedings brought against him for any acts done or omitted to be done or any words spoken by him, in the exercise of his functions under the Constitution or the regulations, as are by law given to acts done or words spoken by a Judge of the High Court in the exercise of his judicial functions. 6. Records of Commission in court. Any report, statement or other communication or record of any meeting, inquiry or proceedings which the Commission, the Chairman or a Commissioner may make in the exercise of its or his functions, as the case may be, under the Constitution or under the regulations, or which the Commission, the Chairman or a Commissioner may make in discharge of any duty to the Governor or to any public officer or authority or to any other person shall be privileged in that its production may not be compelled in any legal proceedings if the Chairman certifies that such production is not in the public interest.
