CENTRE FOR SOCIAL
DEVELOPMENT STUDIES OTORHO,
ARAKA, LAW
Section 1
1. Citation and commencement.
This Law may be cited as the Centre for Social Development Studies Otorho, Abraka, law
and shall come into force on the 15th day of June, 2006.
Section 2
2. Interpretation.
In this Law -
“appropriate authority” means the Commissioner charged with responsibility for
Women Affairs, Community and Social Development matters;
“Board” means the Academic Board of the Centre;
“Centre” means the Centre for Social Development Studies, Otorho, Abraka;
Centre for Social Development Studies Otorho, Abraka, Law
“Governor” means the Governor ofDelta State ofNigeria;
“State” means Delta State of Nigeria.
Section 3
3. Establishment of the Centre.
(1) There is hereby established in the State an institution to be known as the Centre for
Social Development Studies Otorho, Abraka.
(2) The Centre shall be a body corporate with perpetual succession and a common seal,
and shall have power to sue and be sued in its corporate name, and to hold, acquire and
dispose of property, whether movable or immovable.
(3) The Centre shall be self-sustaining and self-financing.
Section 4
4. Obligations of the Centre.
The obligations of the Centre shall be to -
(a) provide courses of instruction and learning on a full-time basis for persons of
either sex without discrimination as to race, sex, tribe, for the purposes of producing
well qualified and suitable intermediate level manpower in Social Development
Studies;
(b) organise and provide training courses leading to diploma, certificate and other
distinction in Social Development Studies;
(c) arrange and provide conferences, fieldworks, seminars, symposia and such like
activities for such persons as may from time to time be determined by the Centre;
(d) conduct research into the theory and practice of Social Development Studies
and make the result of such research to social development workers, teachers and
administrators;
(e) provide the relevant techniques for the transaction and use of the knowledge of
behavioural sciences in life situations;
(f) co-operate with similar institutions in the country in matters of common interest;
(g) provide such other services as the Centre may think fit towards the
advancement of Social Development Studies.
Section 5
5. Collection of fees and levies.
(1) The Centre shall charge and receive such fees and levies from students, as the
Chairman may from time to time determine.
(2) The monies collected in accordance with the provision of this Law shall be paid into
the school account and shall be used for the running cost and administration of the Centre.
Section 6
6. Powers of the Centre.
The Centre shall, subject to the provisions of this Law and any regulation in force, have
powers -
(a) to create posts and offices at the Centre;
(b) to prescribe the academic requirements for new entrants from time to time and
to offer admission to prospective candidates from within and outside the State;
(c) to institute and award scholarships, bursaries, medals, prizes, distinction
awards and other forms of assistance;
(d) to promote discipline and welfare of members of staff and the «students of the
Centre;
(e) either solely or jointly hold examinations and grant diplomas, certificates and
other distinctions to persons who have pursued a course of study, as approved by
the Centre;
(f) to accept gifts, legacies and donations but without obligation" to accept same
for a particular purpose unless, it approves the terms and conditions attaching
thereto;
(g) to enter into contracts, establish trusts, act as trustee, solely or jointly with any
person;
(h) to erect, provide, equip and maintain libraries, laboratories!, lecture halls, halls
of residence, refectories, sports grounds, and things necessary or suitable to or
convenient for any of its functions; and subject to the limitations or conditions that
may be imposed, to invest any money accruing to the Centre by way of endowment,
whether for general or specific purposes and such other moneys as may not
immediately be require for current expenditure, in any investment or securities or in
the purchase or improvement of land, with power from time to time to vary any such
investment and to deposit any money for the time being uninvested with any bank
on deposit or current account.
Section 7
7. Establishment and functions of Board.
(1) There shall be established for the Centre a board to be known as the Board of
Studies which shall consist of the following members.
(a) the Director, who shall be the chairman;
(b) all full-time academic staff;
(c) a representative of Ministry of Finance; and
(d) a representative of Ministry of Education.
(2) There shall be an Administrative Secretary of the Centre, who shall function as the
Secretary to the Board.
(3) The quorum for meeting of the Board, shall be three members.
(4) The Board shall -
(a) be responsible for the policy implementation of the Centre, with respect to
academic matters;
(b) determine the admission requirements for students;
(c) determine the duration and curricula of studies to be conducted by the Centre;
and
(d) determine such other matters as may be referred to the Board.
Section 8
8. Meetings of the Board.
(1) The Chairman shall preside at every meeting of the Board and in his absence the
next most senior staff present shall preside.
(2) The Board shall have power to regulate its own proceedings and to appoint
committees.
Section 9
9. Staff of the Centre.
(1) The principal officers of the Centre shall consist of -
(a) the Director;
(b) the Administrative Secretary;
(c) the Chief Accountant;
(d) the Chief Librarian;
(e) any other staff appointed or seconded to the Centre.
(2) All principal officers of the Centre shall be Public Servants.
(3) The Director shall be the chief executive officer of the Centre.
Section 10
10. Discipline of students.
The Board shall have power to exercise disciplinary control over the students of the
Centre and may issue directives to regulate the conduct of students.
Section 11
11. Funds of the Centre.
The funds of the Centre shall include -
(a) fees and levies charged and received by the Centre;
(b) such sums of money as may accrue to the Centre by way of grants, loans,
subventions and endowments;
(c) donations, gifts and legacies; and
(d) any other resources that may from time to time be vested in the Centre.
Section 12
12. Reports and accounts.
(1) The Centre shall not later than 30th day of March -
(a) prepare a general report of its proceedings and activities during the preceding
year; and
(b) transmit to the appropriate authority through the Director, the report referred
to above together with a certified copy of the audited accounts of the Centre.
(2) The Centre shall -
(a) keep a proper account book;
(b) keep proper records relating to such accounts;
(c) prepare in respect of each financial year a statement of accounts in a form
prescribed by the appropriate authority; and
(d) the Centre shall be audited annually.
Section 13
13. Power to make Regulations.
The appropriate authority shall have power to make regulations for the effective
administration of the Centre.
