Advisory Committee on Education for Citizenship Law

ADVISORY COMMITTEE ON EDUCATION FOR CITIZENSHIP LAW

1. Citation This law may be cited as the Advisory Committee on Education for Citizenship law.

2. Interpretation In this Law, unless the context otherwise requires: "Appropriate Authority" means the member of the State Government for the time being charged with responsibility for education in the State; "Area Committee" means an Area Advisory Committee on Education for Good Citizenship and Leadership established under section 4 of this Law; "Committee" means the State Committee or an Area Committee as the case may be. "Government" means the Government of Delta State of Nigeria; "Governor" means the Governor of Delta State of Nigeria; "National Council" means the National Advisory Council on Education for Citizenship established by the Federal Government; "State" means the Delta State of Nigeria; "State Committee" means the State Advisory Committee on Education for Good Citizenship and Leadership established under section 3 of this Law.

3. Establishment and Composition of the State Committees. (1) There is hereby established for the State a committee to be called the Advisory Committee on Education for Citizenship (hereinafter referred to as “the State Committee”). (2) The State Committee shall consist of the following members- (a) The Chairman; (b) A representative of the Ministry of Education; (c) The General Manager, Nigeria Television Authority Zone covering Delta State; (d) The General Manager, Delta Broadcasting Service; (e) The State Director of information; (f) The state Director of Social welfare; (g) The Director in charge of Education Standards Division; (h) Two representatives of Delta State Wing of National Council of Women Societies; (i) The Chairman of the Local Government Area Committees; (j) An administrative officer not below the rank of Senior Assistant Secretary in the Governor’s Office as Secretary to the Committee; (k) The State Director of Sports. (3) Members of the State Committee other than those named by office shall be appointed by the Governor and may be removed from office by him.

4. Establishment and Composition of the Area Committees (1) There is hereby established for each local government area of the State a committee to be called the Area Advisory Committee on Education for Good Citizenship and Leadership (hereinafter referred to as “the area committee”). (2) An Area Committee shall consist of the following members- (a) The Chairman; (b) The Supervisory Councillor for Education in the Local Government Area; (c) The Assistant Chief Inspector of Education in the Local Government Area; (d) a representative of the Ministry of Information and Culture in the Local Government Area; (e) a representative of the Social Welfare Division of the Ministry of Women affairs, Social Development Youths and sports in the Local Government Area; (f) a representative of Sports Division of Women Affairs, Social Development Youths and Sports in the Local Government Area; (g) a Secondary School Principal; (h) a Primary School Headmaster; (i) a Religious Leader; (j) a member of Parent /Teacher Association; (k) a representative of the National Council of Women Societies in the Local Government Area; (l) an officer not below the rank of assistant secretary in the office of the local government as secretary. (3) Members of an area committee other than those named by office shall be appointed by appropriate authority and may be removed from office in the same manner with the approval of the governor.

5. Tenure of Office of Members The tenure of office of members of the State Committee or of an area committee shall be two years subject to the pleasure to the Governor that every member may be eligible for reappointment.

6. Remunerations of members Members of the State Committee or of an area committee except the official members may be paid such remuneration as the Governor may determine.

7. Functions (1) The functions of the State Committee shall be- (a) to implement such policy as may be laid down by the national council; (b) to plan and draw up programmes and syllabuses in respect of the organisational work relating to the implementation at the state level of the policy of the national council; (c) to issue guidelines and directives to area committees with regard to the functions of such committees; (d) to supervise the area committees and to co-ordinate their activities; (e) to do such other things as it may consider incidental to or expedient for the advancement of the education of Nigerian youths and the inculcation in them of the qualities of good citizenship. (2) The functions of the area committee shall be as may from time to time be directed by the appropriate authority or by State Committee.

8. Meetings of the committee (1) The State Committee and every area committee as the case may be shall meet at such times and in such places as may be directed by the appropriate authority or by their respective chairman and shall meet at least once in every month for the transaction of business. (2) The Chairman shall preside at every meeting of the Committee and in his absence, the other members present shall appoint one of their number to preside thereat. (3) Decisions or resolutions of the committee shall be by simple majority votes of the members present and voting and in the event of an equality of votes the chairman or other members presiding shall have a casting vote in addition to his original vote. (4) At every meeting of the committee seven members one of whom shall be the chairman or the secretary shall form a quorum. (5) The committee shall have power to regulate its own proceedings and subject to subsection (4) of this section, may make standing orders which shall be subject to the approval of the appropriate authority. (6) The Validity of any proceedings of the committee shall not be affected, subject to section 4 of this section by any vacancy in its membership or by any defect in the appointment of a member or by reason that a person not entitled to do so took part in the proceedings.

9. Liability of Members. No member of the State Committee or of an area committee shall be personally liable for any act or default of the committee done or omitted to be done in good faith in the course of carrying out the functions of the Committee under this Law.

10. Annual Report. The State Committee and every area committee shall at the end of every financial year prepare and submit through the appropriate authority to the Governor a report of the activities of the Committee during that financial year.
