Preliminary

ADMINISTRATION OF CIVIL JUSTICE (AMENDMENT) LAW, 2024

Section 1

1. Short Title and Commencement. This Law may be cited as the Administration of Civil Justice (Amendment) Law, 2024, and shall come into force on the date it is assented to by the Governor.

Section 2

2. Interpretation. In this Law, unless the context otherwise requires: "Amendment Law" means the Delta State Administration of Civil Justice (Amendment) Law, 2024; "Governor" the Governor of Delta Slate of Nigeria; "Principal Law" means the Delta State Administration of Civil Justice Law, 2022".

Section 3

3. Amendment of Section 48(1) of the Principal Law. Section 48(1) of the Principal Law is amended by deleting "12 months from the commencement of this Law" and substituting "24 months from the commencement of the Amendment Law".

Section 4

4. Amendment of Section 64(1) of the Principal Law. Section 64(1) of the Principal Law is amended by deleting "12 months from the commencement of this Law" and substituting "24 months from the commencement of the Amendment law".

Section 5

5. Amendment of Section 65(3). Section 65(3) of the Principal Law is amended by deleting "12 months from the commencement of this Law" and substituting "24 months from the commencement of the Amendment Law".

Section 6

6. Transition Provisions. Notwithstanding any provision of the Principal Law, for the purpose of this Amendment Law: (a) Any civil proceeding or application that falls within the scope of Sections 48(1), 64(1), and 65(3) of the Principal Law and is commenced or filed within the original 12-month transition period but before the commencement of this Amendment Law shall continue to be processed in accordance with the provisions of the Principal Law as if this Amendment Law had not been enacted; and (b) The extension of the transition period to 24 months as provided in this Amendment Law applies to any civil proceeding or application that is commenced or filed on or after the commencement date of this Amendment Law.
